				<content:encoded><![CDATA[<p><strong>Horse Accident Renews Calls for Carriage Ban</strong><br />
Another accident with a carriage horse last week has reignited the citywide debate over whether the iconic horse-drawn carriages should be outlawed.</p>
<p>The New York Times and other news outlets reported that around 4:30 p.m. last Thursday, a horse pulling a driver and two passengers got spooked in Columbus Circle and bolted, eventually shedding his carriage, which toppled over. The 6-year-old horse, named Oreo, wasn’t seriously hurt, but did have to be sedated by police with a tranquilizer, and his rampage damaged two cars and injured three people before he was caught on Ninth Avenue.</p>
<p>Upper West Side Assembly Member Linda Rosenthal pointed to the incident as the latest reason to support her bill to ban the carriages in New York.</p>
<p>“I have been calling for an end to a practice that places profit above safety—the safety of the horses and the unsuspecting public for years,” Rosenthal said in a statement. “If an industry is incapable of preventing recurring accidents, the State has a responsibility to step in. We have been lucky up to this point, but our luck is bound to run out.”</p>
<p><strong>Bike Share Pushed Back to Spring</strong><br />
Hopeful cyclists looking forward to taking advantage of the city’s bike share will have to nix their dreams of riding through the crisp fall weather this year. The Department of Transportation announced that the city’s Bike Share program will be delayed—again—and will not be implemented until March 2013. The program, sponsored by Citi with a $41 million investment, will launch with its initial phase of 7,000 bikes at 420 stations spread throughout Midtown and Lower Manhattan, parts of Brooklyn and Queens.</p>
<p>“New York City demands a world-class bike share system, and we need to ensure that Citi Bike launches as flawlessly as New Yorkers expect on Day One,” DOT Commissioner Janette Sadik-Khan said in a statement.</p>
<p>The delay has been blamed on software issues related to the payment and tracking system that Citi Bike will use.</p>
<p><strong>Tavern on the Green Operator Named</strong><br />
The Department of Parks and Recreation announced that they will be awarding a 20-year licensing agreement to the Emerald Green Group, a Philadelphia-based company, to operate and maintain a restaurant at the former Tavern on the Green location.</p>
<p>The selected operator, the Emerald Green Group, swayed the city with its proposal focusing on locally sourced food and a 200-300 person outdoor seating area.</p>
<p>“We are pleased to select the Emerald Green Group as the new operator of Tavern on the Green,” Commissioner Adrian Benepe said. “They have done an outstanding job with Beau Monde in Philadelphia, and their vision for the iconic Tavern on the Green will create a casual restaurant and outdoor café that everyday parkgoers, neighbors and visitors can enjoy.”<br />
The new restaurant is scheduled to open in fall of next year.</p>
<p><strong>Espaillat Gets Major Endorsement</strong><br />
City &amp; State reports that the McManus Political Club, the oldest and only citywide political club in New York, has decided to endorse Sen. Adriano Espaillat’s re-election bid, Espaillat’s campaign said. “As the oldest political club in New York, we know a great elected official when we see one,” the club said in a statement provided by Espaillat’s campaign. “Senator Espaillat has been a strong fighter for New York’s working families. He understands the challenges and opportunities our state faces, and he has demonstrated the leadership needed to move New York forward.” Influential in areas like Hell’s Kitchen, a new part of Espaillat’s Senate district, the club could help Espaillat shore up support there against his opponent, Assemblyman Guillermo Linares. In the latest filing period, Espaillat raised $45,390 and has $38,000 on hand, while Linares raised $28,850, and has $82,000 on hand. Of course, Espaillat’s depleted cash reserves are due in part to a closely contested congressional primary against Rep. Charlie Rangel.</p>
<p><strong>Senate Debate Turns the Heat on Hoylman</strong><br />
City &amp; State reports that Brad Hoylman, a candidate for the seat to be vacated by state Sen. Tom Duane, faced questions earlier this week from Democratic primary opponents about his former job at the Partnership for New York City, a pro-business group where he was a vice president and general counsel. At debate, one candidate, Tom Greco, asked Hoylman what he did to save St. Vincent’s Hospital, since Bill Rudin, the developer behind a controversial plan to redevelop the shuttered hospital, was on the Partnership’s board. Another candidate, Tanika Inlaw, criticized Hoylman’s ties to big business, saying she has no “special interests” backing her. Hoylman, a community board chairman who has the backing of Duane and other members of the party establishment, sought to distance himself from the Partnership, saying the city gives away too many incentives to companies and calling for an end to a carried interest deduction benefiting the city’s many billionaires. He also noted his years of work on affordable housing, public education and open space. “I think my record in the community speaks for itself,” he said.</p>

To the Editor:<br />
Down in Community Board 2, the Department of Transportation (DOT) proposed a bike share station in Father Fagan Square, a half-acre park that commemorates four local heroes who died attempting to save others trapped in burning buildings.</p>
<p>Responding to requests from the Community Board and local civic groups, as well as the current pastor of St. Anthony’s, Father Fagan’s church, the DOT has now agreed to move the intrusive station out of the memorial park.</p>
<p>We should all applaud Community Board 2 for its unwavering support of its neighborhood’s effort to prevent the disruption of a cherished neighborhood space.</p>
<p>We should all commend the DOT for joining them.<br />
And we should all expect this to serve as an example for another cherished quiet refuge, Dag Hammarskjold Plaza, named in memory of another heroic public servant, the secretary general of the United Nations, who was killed in a plane crash in 1961 on his way to a peace mission to the Congo.<br />

<p><strong>Dangerous Ride</strong><br />
To the Editor:<br />
Something was noticeably absent in the letter by H.B. Willis in response to “Going the Way of Horse and Buggy” (June 28): a disclosure. The writer is from Louisiana, not New York City. His motivation is to protect his own business interests, which are more than 1,000 miles from Manhattan and worlds apart in some ways.</p>
<p>Willis assures that horses cannot be “disposed of in an inhumane manner” based on New York City ordinances. From his vantage point, it’s cut-and-dried. But there is nothing in current New York City law to prevent carriage horses from going to auctions frequented by kill buyers. The tiny New York City carriage trade is well aware of a loophole that excuses sellers from any accountability in providing the city with documentation of sales occurring outside of New York City.</p>
<p>Gotham is the topic at hand, not Louisiana. New York City has certain conditions—namely, traffic—that cannot be altered in a way that would make the operation of horse-drawn carriages humane or safe. Horse-drawn carriages in traffic endanger both the horses and public safety. A year ago, we saw serious accidents involving both of these types of risks, both within a 10-day period. In one, a terrified carriage horse bolted and crashed into a parked car; in another, a taxicab crashed into a carriage, seriously injuring three tourists from Ohio and inflicting a head injury that nearly killed the carriage driver.</p>
<p>Carriages are flimsy and offer no protection during a crash. Given that there is no mechanism or requirement for reporting accidents to the city agencies that share industry oversight, some accidents go unreported. How many? Tourists have a right to know just how dangerous these rides really are.</p>

<p>New York is one of the most congested cities in the world. It is no place for slow-moving horses pulling flimsy carriages mixed in with taxis, fire trucks, police cars and buses.</p>
<p>In January 2006, a horrific accident occurred on 9th Avenue and 50th Street that involved a young carriage horse named Spotty, who was returning to his stable. Reacting to unknown stimuli, he bolted frantically into traffic, smashing into a station wagon and wrapping himself over the vehicle, the carriage still attached. He was later euthanized and his driver hospitalized in a coma. Unfortunately, this is typical horse behavior.</p>
<p>This was the beginning of our campaign to shut down the inherently inhumane and unsafe horse-drawn carriage trade in New York City, an industry that has no more than 160 active members but remains politically entrenched. It is an industry that a majority of New Yorkers want banned.</p>
<p>At that time, we needed to re-educate politicians, media and even activists. Today, the issue has caught on and has received much publicity. Several other organizations are also involved. It is an issue whose time has come.</p>
<p>More and more people around the globe are becoming sensitized to animal suffering and want it to stop. From cities legislating a ban on bull fighting or animal circuses to campaigns to ban inhumane horse-drawn carriages in Rome, Vienna, Chicago, Cozumel and Atlanta, to name a few, the time has come for animals to be given their due. To an enlightened populace, ethics, morality and compassion trump selfishness and greed every time.</p>
<p>The New York City law allows these dispirited carriage horses to work for nine hours straight, seven days a week between the shafts of their carriage, either pulling or parked waiting for a customer—bored, captive, not even able to scratch an itch.</p>
<p>As herd animals, horses need turnout to pasture to mingle with other horses, graze on grass and mutually groom each other, a great stress reliever. This does not exist in the New York City stables. The five-week so-called furloughs will never substitute for daily turnout.<br />
The horses live in four multistory stables on the far west side of Manhattan, where the stalls, legislated at 60 square feet minimum, are less than half the size experts recommend—stall guidelines for voluntary certification by the New York state Horse Health Assurance Program are 144 square feet for mid-sized horses and 196 square feet for larger drafts. These stalls are mostly on the upper levels, accessed by a steep ramp.</p>
<p>Since July 2011, there have been 11 carriage horse incidents, including one horse death, that of Charlie, who dropped dead on Oct. 23, 2011, while pulling a carriage. Several others were due to the horse spooking, but on Nov. 4 and again on Dec. 4, a horse collapsed on the street while pulling a carriage. There is no reporting requirement in the law, so it is probable that many more accidents occur and go undocumented.</p>
<p>Every poll that has been taken since 2006—including those by CBS, The Wall Street Journal, New York Daily News and Extra—shows 75-80 percent of respondents favor a ban of the industry. Currently, we have over 122,000 signatures on an online petition in support of the Avella/Rosenthal state bill to ban the New York City carriage industry.</p>
<p>While the people want a ban, politicians are a different matter. In 2009, the Teamsters began to represent the carriage drivers. It is not a real union shop; there is no collective bargaining or benefits, and owners and drivers are in one local. Only about half of the owners and drivers are members. But, as a strong union, the Teamsters wield much influence with City Council members who could otherwise make a difference.</p>
<p>The city has enabled this tiny business for years, granting such things as under-market rent for a city-owned stable, killing a Council bill that would have mandated sprinklers and quashing a bill that would have prevented the horses from going to slaughter auctions, the latter thanks to Council Speaker Christine Quinn.</p>
<p>Currently, drivers are not accountable for horses sold outside New YorkCity, so it is not known where the majority of them go—a huge turnover of 60-70 horses each year.</p>
<p>Our goal is to see the industry shut down and the horses retired to a sanctuary or a good home. It is time to move New York City into the 21st century with compassion for all beings.</p>

<h3>Support the Bill</h3>
<p>It is not a surprise to read that those making a living off the backs of the New York City carriage horses want to see the industry continue.</p>
<p>It’s the people WITHOUT a financial interest in it whose opinion should be taken most to heart, and the great majority of those people want to see an end to this antiquated business.</p>
<p>Note that the recent reports of accidents and deaths are only the ones that have been captured by cell phone and camera; it’s logical to assume that there are many other stumbles, spooks, collapses and, maybe, deaths that go unreported.</p>
<p>Please support State Sen. Tony Avella and Assembly Member Linda Rosenthal’s bill to ban horse-drawn carriages in New York City, and then let’s do all we can to prevent Christine Quinn from becoming mayor in 2013, as she is a staunch supporter of the carriage industry.</p>

<h3>A Gold Standard</h3>
<p>Just finished reading the article by Anam Baig and Sean Creamer. I am not a city resident but a frequent visitor, living in Sleepy Hollow, Westchester County. Having owned and ridden horses for the better part of 15 years, I have some knowledge of the horse world.</p>
<p>It appears that the New York Horse and Carriage Association has done its due diligence for the profession. The formation of ClipClopNYC to distribute information and open its doors to the general public is a gold standard for any profession. The fact that the New York City Department of Health and Mental Hygiene licenses the horse and carriage industry is another gold standard.</p>
<p>Have horses sustained injuries in the carriage business? Yes, they have. If one were to really examine the circumstances surrounding these incidents, I am sure that much less sensational stories would emerge than what appears in the local papers and would certainly diminish the fire behind the so-called activism.</p>

<h3>All in Your Mind</h3>
<p>The bottom line is that it is far safer to take a carriage ride than ride a bike. Or walk or exist. The argument “carriage horses are abused because the city is a risky place to live” is hilarious. Ban all animals and living beings in New York City because they are mortal. Grow up, peeps. The stables are great, the horses are great. The only abuse is in your own heads.</p>

<h3>Right From Wrong</h3>
<p>Having just finished reading the article with great hope that it would be in favor of abolishing the carriages, I was dismayed to see it take a turn toward the opposite. I’m certainly not against the presentation of both sides, but it seemed to me it weighed heavily in favor of the carriage industry.</p>
<p>Then on to the comments (sigh), all of which seemed to be written only by carriage supporters. Excerpt: “look at the faces of the children when they see the horses, when they get to pet the horses and, if they’re lucky, get to feed the horses a carrot.” As if this cruel industry was all sweetness and light (not to mention this is not about the delight of children). But I suppose any press is good that brings this situation to light. Those with a conscience will know right from wrong.</p>

<h3>Ranches Next?</h3>
<p>It seems to me that if the stables and horses are well kept, as the experienced horse people seem to be saying (horse people are generally the FIRST to shut down horse abuse!), then the animal rights people have forgotten that America was founded on the relationship between people and horses. How did we transport ourselves and our belongings to the West Coast to achieve “Manifest Destiny”? How do we catch and medicate cattle on 600,000-acre ranches—will we ban the use of horses on ranches and relegate those cows to live in large sheds instead of roaming the range?</p>

<h3>Well Taken Care Of</h3>
<p>We went to ClipClopNYC to see for ourselves what was going on with the New York carriage horses. We found a pleasant, well-kept working barn. The horses looked good and were well-groomed. They were friendly and wanted to interact with our large group as we wandered about the building. An abused or stressed animal would go to the back of the stall and attempt to ignore us or turn away. Not these guys; they were very friendly—something a horse out in public needs to be.</p>
<p>The stable was airy, with good ventilation. Fans and misters were available for summer heat. There were sprinklers throughout the building. Each stall was matted and well bedded. There was free-access hay and water. Manure was managed well enough that there was next to no odor in a building housing 75 horses—something that is not possible if it is not regularly kept up with. The workers we saw throughout the building were calm and gentle with the horses and we saw several being prepared for their day’s work—including walking down the ramps. The horses negotiate the ramps at a normal walk, not sliding down or walking with a hesitating step as if to keep their balance. Not an issue to be concerned with.</p>

<h3>Horses Can’t Cope</h3>
<p>I don’t know if you folks missed the fact that there are no sprinklers on street corners, no hay beds in the roads, no fans or heaters. New York City climates are hard to endure at times, but people can cope—we can stop in air-conditioned stores or heated cabs. For the horses, it’s not all that simple.</p>
<p>You speak of ignorance, but there is no greater ignorance than the refusal to change. How can you possibly say that a horse is better off living in crowded New York City than in an open field, free to roam where they please? If you want your kids to see a horse, take them to a farm, not Central Park.</p>

<p><em>Will the Central Park horses finally be outlawed?</em></p>

<p>Central Park’s horse-drawn carriages have been a traditional New York City tourist attraction since the 1930s, but animal rights activists have been pushing for years to close the stables, free the horses and find them a home outside the Big Apple.</p>
<p>Three recent incidents involving the horses have resparked the debate and shed light again on the horses and the iconic tourist experience. March 3, a horse was spooked on the Upper West Side and took off, dragging a tipped carriage through heavy traffic. Last December, a horse collapsed near Grand Army Plaza at 59th Street while pulling a carriage holding three adults and a child, tossing them to the ground. In October, another horse, Charlie, died while pulling a carriage on the way to Central Park.</p>
<p>Those in favor of the horse carriages claim that the incidents are sporadic and don’t reflect the high standard used by the industry. The opponents claim that it’s just another day at work for the horses.</p>
<p>Two dueling events happened last weekend when the groups gathered to build momentum on their side as the debate rages. A slew of equestrians from all over the country gathered March 30 to attend ClipClopNYC, where the Horse-Carriage Association of New York welcomed members of the public to see behind the scenes of the industry. The event included tours of the stables, a meet-and-greet with veterinarians who work with the horses and an informational session at Central Park. The event touted the industry’s partnership with Blue Star Equiculture of Palmer, Mass., where retired horses go to live after serving on the streets of New York City.</p>
<p>To counter that event, the Coalition to Ban Horse-Drawn Carriages, working with other animals rights groups, held an event of its own Sunday, April 1, to protest ClipClopNYC and expose the carriage industry’s practices.</p>
<p>But things weren’t always so black and white for horses in the park.</p>
<p>Frederick Law Olmstead’s original 1870s design of Central Park was meant for horse-drawn carriages both as a means of transport and recreation. Now that those times have passed, many people are vying for the carriages’ ban, citing that the horses are put under unnecessary strain, suffer subpar living conditions and lack roaming space.</p>
<p>Upper West Side Assembly Member Linda Rosenthal and Queens Senator Tony Avella introduced legislation last spring that would ban horse-drawn cabs in the city.</p>
<p>“These horses get easily spooked on city streets. Its not their natural habitat,” Rosenthal said. “It’s dangerous for them and the people in the carriage. My aim is to relieve the horses of work that they are forced to do, dragging hundred and hundred of pounds of carriage and people all day long.”</p>
<p>At the City Council level, legislation sponsored by Councilwoman Melissa Mark-Viverito would ban the use of horse-drawn carriages in the park, allowing electric cars to take the place of the horses as a tourist attraction.</p>
<p>“We support any legislation that gets these horses out of harm’s way,” said Carly Marie Knudson, executive director of NYCLASS, a group that wants to end the use of carriage horses in the city.</p>

<p>“We think the City Council’s route has the advantage of offering an alternative that saves the horses while simultaneously creating new jobs and boosting revenue to the city through the vintage replica cars,” she said.</p>
<p>NYCLASS was founded by Manhattan Mini Storage and Edison ParkFast owner Steve Nislick and Ed Sayres, co-president of the American Society for the Prevention of Cruelty to Animals (ASPCA). The ASPCA not only acts as the government watchdog for the carriage industry, it donated $250,000 to NYCLASS to support their electric car cause.</p>
<p>Animal rights activists such as NYCLASS, The Coalition to Ban Horse-Drawn Carriages, Friends of Animals, the ASPCA and People for the Ethical Treatment of Animals (PETA) claim that the horse-carriage industry is equine abuse in its worst form.</p>
<p>But those who are a part of the carriage industry say otherwise. Carriage drivers interviewed for this story were adamant that there is no animal abuse. They claim that PETA and the ASPCA, among others, have stalked carriage drivers at the park and stables with video cameras, looking for instances of abuse. But, according to the drivers, they’ve left empty-handed every time.</p>
<p>Conor McHugh, a carriage driver of 26 years, said protesters of the industry have yelled at customers and at times thrown water or spit on them for taking a ride.</p>
<p>“It’s shameful to the city that allows it—that the customers, tourists of this city, get spat on by people because they decide to take a horse and buggy ride,” McHugh said.</p>
<p>In order to become a driver, applicants must go through oral and multiple-choice exams proctored by the New York City Department of Health and Mental Hygiene, which licenses New York City’s horse carriages. After they get their license, newly established drivers take a test run with an experienced driver for a week to ensure they pick up the skills needed to successfully and safely operate a horse.</p>
<p>New horses from the Pennsylvania stables in Amish country are tested for their ability to work the busy Central Park streets. If the horses do not become accustomed to the incessant traffic noise, bustling crowds and gawking tourists, they are sent back.</p>
<p>“Maybe sometimes they get used to it, but they can get spooked,” said Edita Birnkrant from Friends of Animals, a group that proposes banning animals in the park. “They have an innate instinct. Nothing can change that. There will be times when the horse will startle, and then you have 2,000 pounds of wild animal running out of control in a metropolitan hub.”</p>
<p>The horse-drawn carriage industry has faced scrutiny before. In 1988, when three horses died during a heat wave, the City Council enacted a New York City Administrative Code that regulated carriage horse operation, required licensure of the horse, carriage and driver, and established standards for horse treatment and a horse health advisory board to make recommendations to the commissioner of health.</p>
<p>Since then, the Code has seen many amendments focused on improving the quality of life and well-being of New York City’s carriages horses.<br />
The horses are kept in four stables on the Upper West Side, an area that has been undergoing renovations over the past 10 years, according to Steven Malone, president of the New York Horse and Carriage Association, which represents the city’s 68 carriages, 293 certified drivers and 220 privately owned horses. The stable on 52nd Street has three levels that are connected by ramps, another facet that activists say is dangerous for the horses.<br />
The bottom level holds the carriages. Above them, the horses live in individual stables. The horses have constant access to water and food and their bedding is changed three times a day, according to various drivers who, like McHugh, keep their horses at the stable.</p>
<p>McHugh stood against a backdrop of stable workers cleaning out the empty stables of the horses that had left for work earlier in the morning and explained that if NYCLASS or Friends of Animals get their way, these men would lose their jobs.</p>
<p>“We have people in this business who inherited it from their fathers in the 1950s,” said McHugh. “That’s a long, continuous connection, and someone like the assemblywoman just proposes that we be banned? It just seems so draconian.”</p>
<p>Horses are supposed to work every other day and only for nine hours at a time, giving them the chance to rest after a day of lugging carriages and tourists around from the day before, a result of previous legislature to ensure the horses are treated fairly. ASPCA veterinarians examine them twice a year.</p>
<p>Last year, the ASPCA did an intensive study of the horses for 281 days and found no instances of abuse, according to McHugh.</p>
<p>“The horses have to be groomed and presented everyday. We present them everyday on Fifth Avenue,” said McHugh. “Inspection does not go on behind closed doors.”</p>
<p>But activists say that the abuse exists in the fact that the horses must endure the conditions of the city. Janet Restino, an artist who lives near the stables on the UWS, agrees with this sentiment.</p>
<p>“I don’t think it is a particularly great idea to have horses on the street during traffic and rush hour,” Restino said.</p>
<p>Ivanna Fairweather, a Harlem resident who was walking in Central Park on a recent bright, sunny day, said she’s in favor of a ban.</p>
<p>“We have so many other forms of transportation, why do we need horses? People just want to say, ‘Oh, I took a horse ride in Central Park.’ But those pretentious people don’t know that taking a walk in Central Park is so much better,” she said. “New York is a place to walk; it’s a walking city. We don’t need horses to take us places. I mean, $50 for 20 minutes? What? Are they crazy?”</p>

<p>The ASPCA reaffirmed its offer to find homes for 22 carriage horses after the city closed Shamrock Stables, on West 45th Street. The property will be used to build a new residential development and expand a nearby school. The stable owners, however, declined the offer. <span id="more-6143"></span></p>
<p>“An offer was made to the Shamrock Stables, who were saying that if they were to be evicted, they didn’t know where the horses would go, but they did not accept that offer,” said Melissa Norden, chief of staff for the ASPCA. “We’re waiting for information, but as of now we’re unsure of the location of the horses.”</p>
<p>So far, 16 of the 22 horses were relocated to other stables in the city, according to the New York Times. The other six were trucked to the Shamrock Stables owner Ian McKeever’s farm in Pennsylvania.</p>
