Cheeky Photos Barred From Grope Case

    Multiple ass-portraits will not be used in the case against [subway-pervert Darnell McGee] thanks to cops who failed to obtain a search warrant for the guy’s camera phone. Nevertheless, McGee, 33, is charged with [forcible touching and sexual abuse](http://www.nydailynews.com/news/crime_file/2007/07/13/2007-07-13_judge_kicks_butt_pix_in_subway_grope_cas-2.html) for allegedly grabbing a woman's rear after photographing it at the Union Square subway station last July.

    Transit Bureau Officer Ivan Rodriguez and his partner, Alexander Bradshaw, spotted McGee as he conducted his photo shoot and subsequently followed him on a train uptown to 42nd St. and then back to Union Square, during which Rodriguez says he saw McGee direct his phone toward the victim’s tush and then grab it several times. After arresting McGee, Rodriguez and Bradshaw took inventory of his possessions, at which point the former cop scrolled through McGee’s phone and found the incriminating photos.

    But Manhattan Criminal Court Judge Anthony Ferrara has ruled that the [amateur shots are inadmissible] because they were obtained during an illegal search as Rodriguez didn’t first file the necessary paperwork. How does the over-zealous, 2-and-a-half-year veteran of the force explain his failure to follow proper routine procedure? He didn’t know.
